Who do I call to report a nursing home in New York?
Contact the New York State Department of Health Nursing Home Complaint Hotline at 1-888-201-4563, available 24 hours a day. You can also submit a written complaint online through the NYS DOH complaint portal. The DOH is required to investigate all complaints alleging resident harm.
What kinds of problems can I report about a nursing home?
You can report any concern related to resident care, safety, or rights -- including physical abuse, sexual abuse, verbal abuse, neglect, improper medication, unsanitary conditions, unexplained falls, malnutrition, dehydration, or financial exploitation. New York nursing homes are licensed and regulated, and the DOH investigates allegations of violations of state and federal standards.
Does New York law give nursing home residents the right to sue?
Yes. Under NY Public Health Law §2801-d, nursing home residents have a private right of action against facilities that deprive them of rights or benefits guaranteed under state or federal law -- including the right to be free from abuse and neglect. Residents or their families can pursue a lawsuit for damages caused by a facility’s failure to meet its duty of care, independent of any regulatory complaint.
Can I file a complaint anonymously and will it protect my loved one from retaliation?
The NYS DOH accepts anonymous complaints, and New York law prohibits nursing homes from retaliating against residents or family members who file complaints. If you believe a resident has been retaliated against after a report, you can notify the DOH immediately. Facilities found to have retaliated face additional regulatory penalties.
