Can the institution be held responsible even if the abuser was never criminally charged?

Yes. Civil liability under New York law is entirely independent of any criminal prosecution. Survivors can pursue a civil lawsuit against a school, church, camp, or other institution based on negligent hiring, supervision, or retention — regardless of whether criminal charges were ever filed or resulted in a conviction.
