New York City’s construction sites are bristling with “heavy machinery,” a broad category that includes most heavy-duty vehicles that make earthworks and other large construction jobs possible. Tractors, bulldozers, excavators, backhoes, pipelayers, loaders, cherry pickers, cranes, forklifts, pavers, compactors, rotary tillers, dump trucks – the list is long and varied.
And while these machines are necessary, they must be operated and maintained exactingly, by trained professionals who consistently exercise great caution. The Occupational Safety & Health Administration (OSHA) has designed a lengthy list of safety regulations, meant to protect workers operating heavy machinery and others on the job site. Even so, many construction workers in New York City are seriously injured in heavy machinery accidents every year.

In 2013, the Occupational Safety & Health Administration (OSHA) released a list of their most frequently cited workplace violations. Coming in at #6 were infractions relating to “Powered Industrial Trucks” (PIT), or heavy machinery.
Using heavy machinery is so dangerous in part because every machine presents multiple hazards to a worker. The most common types of PIT accidents include:
[and] intact windshield with working windshield wipers.”
In addition to these regulations that pertain to vehicles, the roadways, and surfaces that heavy machinery use must meet certain standards. Access roadways and grades must be “constructed and maintained to safely accommodate the equipment and vehicles involved.” OSHA requires that these surfaces are able to support heavy machinery when it is fully loaded.
Injured workers across New York City know that New York State’s Workers Compensation system can be less than helpful after an accident. Many insurance companies will even try to minimize the appearance of your injuries, and limit the amount of compensation to which you are entitled.
